The Terms & Conditions govern checkout, purchase, payment, digital delivery, and contract formation.
The Full Commercial + Resale License governs what you may do with a purchased Artwork.
The Returns & Refund Policy governs refunds, replacements, redelivery, and remedies.
Where those documents expressly address a matter more specifically than these Terms, the more specific document controls that matter.
3. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to place an Order independently.
If permitted by applicable law, a person below the age of majority may use the website only with appropriate authorization and supervision from a parent or legal guardian.
By using the website or placing an Order, you represent that:

The purchased product consists of the Digital File and the rights expressly provided under the applicable License.
8. Product Information
We make reasonable efforts to describe products accurately.
Product listings may identify:

Artwork appearance;

File format;
-
Pixel dimensions;
-
Aspect ratio;
-
Resolution;
-
Included files;
-
License information;
-
Delivery method; and
-
Other relevant technical specifications.
Where a product is expressly advertised as an 8000 × 8000 pixel JPEG, that specification applies to the delivered master file for that product.
Website images may be resized, compressed, or optimized for display.
The delivered Digital File, not the browser-rendered preview, is the purchased master file.
9. Artwork Previews
Website previews are provided so that you can evaluate the visible Artwork before purchase.
A preview may differ technically from the delivered master file because it may be:

Resized;

Compressed;
-
Optimized;
-
Displayed at reduced resolution; or
-
Adapted to responsive website layouts.
You may not treat website infrastructure, source code, product-page layouts, or other non-Artwork site content as licensed merely because an Artwork itself may later be purchased under a broad License.
10. Orders
Submitting an Order constitutes an offer to purchase the selected product under the applicable Terms & Conditions and Policies.
An automated confirmation may acknowledge the Order without constituting final acceptance.
An Order is ordinarily accepted when:

Payment is authorized or received; and

Functional access to the purchased Digital File is supplied.
We may decline, cancel, hold, or limit an Order before delivery where reasonably necessary, including where:

Payment cannot be authorized;

Fraud is suspected;
-
Checkout information is materially inaccurate;

A product is unavailable;
-
A material pricing error exists;
-
A technical issue prevents delivery;

Applicable law prevents the transaction; or

A payment provider or authority requires restriction.
For clarity, an intention to lawfully resell or redistribute a purchased Artwork under the Full Commercial + Resale License is not by itself a prohibited reason for refusing an Order.
11. Prices
Prices displayed on the website may change at any time.
The amount displayed during checkout before submission of the Order controls the amount payable for that transaction.
Later price reductions do not entitle prior customers to retrospective price adjustments unless we voluntarily offer them.
We may correct an obvious material pricing error before delivery.
12. Currency
Prices may be displayed in a currency determined by:

18. Immediate Digital Supply

Immediate supply does not remove mandatory rights where digital content is:

19. Download Responsibilities
After delivery, you should:

Maintain your own backup.
We do not guarantee indefinite hosting or permanent re-download access unless expressly stated.
We are not responsible for file degradation resulting from:

Incorrect resizing;

Screenshots;
-
Repeated exporting;
-
Device failure;
-
Customer editing; or
-
Third-party platform processing.
20. Full Commercial + Resale License
Eligible purchased Artwork includes the rights stated in the applicable Full Commercial + Resale License.
The License may permit broad uses including:

Personal use;
-
Commercial use;
-
Modification;
-
Physical-product sales;
-
Print-on-demand use;
-
Digital resale;
-
Redistribution;
-
Digital products;
-
Client work;
-
AI and machine-learning use;
-
Dataset use;
-
NFT use;
-
Downstream distribution; and
-
Other lawful commercial activity.
The Full Commercial + Resale License controls the precise scope of those rights.
21. Digital Resale and Redistribution
Digital resale and redistribution of a lawfully purchased Artwork are permitted where authorized by the applicable License.
This may include resale or redistribution of:

The original Digital File;
-
Modified versions;
-
Derivative versions;
-
Bundles;
-
Collections;
-
Downloadable products; or
-
Other licensed applications.
A person exercising those rights is responsible for:

Their own marketplace compliance;
-
Customer representations;
-
Downstream terms;
-
Taxes;
-
Advertising;
-
Applicable law; and
-
Any independent obligations arising from their resale business.
Digital Artwork Gallery is not a party to transactions between a Licensee and the Licensee’s customers unless expressly stated otherwise.
22. Website Access Is Different From Artwork Rights
The broad License applying to a purchased Artwork does not grant rights to the entire Digital Artwork Gallery website.
You may not treat the following as licensed merely because they appear near or around an Artwork:

Page templates;
-
Navigation;
-
Store design;
-
Product descriptions;
-
Legal policies;
-
Branding;
-
Logos;
-
Business names;
-
Databases;
-
Account systems;
-
Checkout systems;
-
Internal prompts;
-
GPT instructions;

Automation;
-
Private workflows; or
-
Non-public business information.
Rights in a purchased Artwork and rights in the website are separate.
23. Protected Download Links
You may redistribute a downloaded Digital File where the applicable License permits it.
However, you must not publicly share, sell, publish, or exploit a protected Order-specific download URL, account session, customer-account credential, or checkout-access mechanism where doing so:

Exposes customer information;

Circumvents security;
-
Grants unauthorized account access;
-
Bypasses delivery controls; or
-
Interferes with the website.
Where redistribution is permitted, share the lawfully downloaded Digital File rather than another person’s protected account or Order-access mechanism.
24. Permitted Website Use

Digital Artwork Gallery uses artificial-intelligence-assisted and digital creative processes in developing Artwork.
These processes may assist with:

Digital Artwork Gallery grants only rights that TP E-COMMERCE LLC is legally entitled to grant.

Where authorized by the applicable Full Commercial + Resale License, customers may use purchased Artwork in:

Fine-tuning;
-
Datasets;
-
Image-to-image systems;
-
Automated design processes;

Transformative workflows; or

Other lawful AI applications.
Third-party AI providers may impose their own rules.
Digital Artwork Gallery does not guarantee that every third-party platform will accept every proposed use.
30. Proprietary Systems
Your purchase does not provide access to or ownership of:

Internal GPT instructions;
-
Prompts;
-
System messages;
-
Model configurations;
-
Automation;
-
Generation workflows;
-
Quality-control systems;
-
Internal business processes;
-
Private datasets;

Internal production systems; or

Confidential information.
You may not attempt to obtain such non-public information through unauthorized access, security circumvention, or exploitation of the website.
31. Copyright Status and Ownership
Purchasing an Artwork does not automatically transfer exclusive copyright ownership in the original Artwork.
To the fullest extent legally applicable, TP E-COMMERCE LLC retains the underlying rights it owns or controls.
The Full Commercial + Resale License grants contractual usage rights without making the purchaser the exclusive owner of the original Artwork.
The legal protection available for individual AI-assisted elements may differ by jurisdiction.
32. Non-Exclusive Products
Unless expressly stated otherwise, Artwork is offered non-exclusively.
This means:

Multiple customers may purchase the same Artwork;

Multiple customers may use it commercially;

Multiple customers may resell it;
-
Multiple customers may redistribute it;

Multiple customers may modify it; and
-
Digital Artwork Gallery may continue offering it.
A purchaser must not assert exclusive ownership rights that were not granted.
33. Trademarks and Exclusive Rights
A broad commercial License does not automatically mean that an Artwork is suitable for exclusive trademark registration.
You are responsible for obtaining appropriate legal advice before attempting to use an Artwork as an exclusive:

Trade dress; or

Source identifier.
You must not knowingly assert rights that would improperly prevent Digital Artwork Gallery or another authorized Licensee from continuing to use the original Artwork.

Claims arising solely from independent physical production should ordinarily be directed to the relevant provider.

44. Refunds, Reversals, and License Termination

Where an Order is fully:

Cancelled;

Reversed;

Charged back; or
-
Determined to be unauthorized,
the License granted directly to that purchaser ordinarily terminates unless we expressly state otherwise.
The purchaser may not rely on a terminated License to make new sales, distributions, or other commercial uses.
Lawful downstream transactions completed while the License was valid are addressed under the applicable License, Returns & Refund Policy, Terms & Conditions, and applicable law.
45. Chargebacks
Nothing in these Terms prevents a genuine dispute concerning:

To the maximum extent permitted by law, our aggregate liability arising from a particular product or Order will not exceed the amount actually paid to Digital Artwork Gallery for that product or Order.
This limitation does not apply where liability cannot legally be limited.
50. Indemnification for Commercial Use
To the maximum extent permitted by applicable law, particularly where you use Artwork commercially, you agree to indemnify and hold harmless TP E-COMMERCE LLC, Digital Artwork Gallery, and their managers, officers, employees, and contractors from third-party claims arising from:

Your use of an independent manufacturer, AI system, platform, or service.
This obligation does not apply to the extent the claim arises solely from unlawful conduct by TP E-COMMERCE LLC.
Mandatory consumer law remains unaffected.
51. Suspension and Termination
We may suspend or terminate website, account, download, or service access where reasonably necessary because of:

Utility failures;

Natural disasters;

Flood;

Public-health emergencies; or

Widespread third-party service failures.
Mandatory legal remedies remain unaffected.
53. International Use

You are responsible for ensuring that your access and intended activities comply with laws applicable to you.
You must not use the website where doing so violates applicable:

You and Digital Artwork Gallery consent to those courts to the extent legally permitted.
These Terms do not prevent use of a regulator, court, or consumer-protection procedure that cannot legally be excluded.
57. Assignment and Downstream Artwork Rights
You may transfer, resell, redistribute, or grant downstream rights in purchased Artwork to the extent expressly permitted by the Full Commercial + Resale License.
That permission does not transfer:

Ownership of Digital Artwork Gallery;

Website ownership;

Internal systems;
-
Business assets;
-
Branding;
-
Trademarks;
-
Underlying exclusive copyright ownership; or
-
Rights beyond those granted under the applicable License.
Your general website account and these Terms themselves may not be assigned in a manner that creates unauthorized access to protected account or customer information.
We may assign these Terms in connection with:

Financing;
