1. WEBSITE OPERATOR

Digital Artwork Gallery is operated by TP E-COMMERCE LLC, a business organized in the United States.

The Digital Artwork Gallery name, Website, services, Artwork collection, Membership offerings, and related commercial activities are operated through TP E-COMMERCE LLC unless expressly stated otherwise.

2. PURPOSE OF THE WEBSITE

Digital Artwork Gallery provides an online platform through which customers may:

Browse digital Artwork;
Purchase Digital Artwork;
Acquire Artwork through Gallery Membership Benefits;
Obtain commercial usage rights under the Commercial License;
Access Digital Files;
Join The Gallery;
Manage Membership access;
Review licensing information;
Review Artwork information; and
Use related services.

Unless expressly stated otherwise, products offered through Digital Artwork Gallery are digital.

3. DIGITAL ARTWORK COLLECTION

Artwork offered through Digital Artwork Gallery is provided under the Commercial License.

This Artwork is generally:

Non-exclusive;
Commercially usable;
Royalty-free;
Available to multiple customers; and
Subject to the restrictions stated in the Commercial License.

Purchasing or acquiring Artwork does not transfer exclusive ownership or copyright in the underlying Artwork.

Digital Artwork Gallery retains the rights it owns in the original Artwork.

4. THE GALLERY MEMBERSHIP

The Gallery is a recurring digital Membership program.

While an eligible Membership is active and validly paid, current Membership Benefits include:

100% off every digital artwork available at Digital Artwork Gallery.

Membership Benefits may become available immediately after successful Membership activation unless otherwise expressly stated.

Digital Artwork Gallery adds at least 3 new digital artworks every day except Sunday.

Membership does not automatically transfer or deliver every Artwork available on the Website.

The customer must complete the applicable acquisition or checkout process.

5. DIGITAL ARTWORK ACQUIRED THROUGH MEMBERSHIP

Digital Artwork validly acquired through an active and validly paid Membership is subject to the same applicable Commercial License as individually purchased Digital Artwork.

Where Digital Artwork is acquired through Membership Benefits, its Artwork price may be reduced by 100%.

Accordingly, an active Gallery Member may acquire eligible Digital Artwork at no additional Artwork cost while Membership remains active.

The fact that a separate Artwork price was reduced to zero does not reduce the scope of the Commercial License.

Membership does not automatically grant rights in Artwork that the member has not validly acquired.

6. MEMBERSHIP EXPIRATION AND PREVIOUSLY ACQUIRED ARTWORK

A later normal Membership cancellation or expiration does not, by itself, terminate a valid Commercial License for Digital Artwork lawfully acquired during a fully paid Membership Period.

After Membership ends:

Membership discounts cease;
The member may no longer acquire new Digital Artwork using expired Membership Benefits;
New Digital Artwork releases are no longer available through the expired Membership benefit; but
Commercial Licenses for Digital Artwork already validly acquired ordinarily remain in effect.

Refunds, chargebacks, reversals, unauthorized payments, and other payment-invalidating events may affect Membership Benefits and associated rights as described in the Returns & Refund Policy and Terms of Service.

7. WEBSITE ARTWORK PREVIEWS

Artwork displayed on the Website may appear in:

Product previews;
Collection pages;
Thumbnails;
Promotional images;
Search results;
Editorial content;
Membership pages; or
Other Website displays.

Website previews may:

Be resized;
Be compressed;
Use different dimensions;
Contain interface elements;
Use reduced resolution;
Appear differently depending on the device or browser; or
Differ technically from the delivered master Digital File.

The delivered master Digital File should be used for licensed:

Printing;
Editing;
Physical-product production;
Client work;
Advertising;
Websites;
Social media;
Publications;
Presentations;
Videos;
Print-on-demand;
Permitted AI-assisted creative workflows; and
Other lawful commercial activity permitted by the Commercial License.

Website previews are not licensed as separate products merely because they are publicly visible.

8. COMMERCIAL LICENSE

Eligible individually purchased and Membership-acquired Artwork includes the rights stated in the applicable Commercial License.

Subject to that License, customers and members may generally use validly acquired Digital Artwork for broad personal and commercial purposes.

Permitted uses may include:

Personal use;
Commercial use;
Printing;
Physical-product sales;
Merchandise;
Print-on-demand;
Advertising and marketing;
Websites and social media;
Publications;
Packaging;
Presentations;
Videos and other finished digital content;
Modification;
Incorporation into larger original designs;
Client projects; and
Permitted private creative or AI-assisted workflows.

Unless expressly authorized in writing, the Commercial License does not permit:

Digital resale of the Artwork itself;
Redistribution of the Digital File;
Sale as a standalone digital download;
Sublicensing;
Transfer of the Commercial License;
Independent file sharing;
Inclusion in downloadable Artwork bundles or collections;
Inclusion in stock or digital asset libraries;
Inclusion in another Membership or subscription service;
Distribution as clip art, wallpaper, backgrounds, stock imagery, or similar digital assets;
Distribution of modified versions that function as substitutes for the original Artwork;
NFT or standalone digital collectible sales;
Distribution as training data;
Inclusion in downloadable datasets; or
Other uses prohibited by the Commercial License.

The applicable Commercial License governs the precise scope of those rights and restrictions.

Artwork acquired at 100% off through a valid Membership is not granted a reduced Commercial License merely because no separate Artwork price was paid.

9. DIGITAL RESALE AND REDISTRIBUTION

Digital resale, redistribution, sublicensing, and independent distribution of the Artwork or Digital File are not permitted unless expressly authorized in writing by Digital Artwork Gallery.

Customers and members may not:

Resell the original Digital File;
Offer the Artwork as a standalone digital download;
Redistribute the Digital File;
Give copies to others for independent use;
Include the Artwork in digital bundles;
Include it in downloadable collections;
Include it in stock or asset libraries;
Include it in Memberships or subscription services;
Sell substantially unchanged or lightly modified versions as digital assets;
Sublicense the Artwork;
Transfer the Commercial License; or
Otherwise make the Artwork available for independent reuse by third parties.

Modification does not remove these restrictions.

Customers may use the Artwork on physical products and in finished commercial projects where permitted by the Commercial License.

Customers may also provide the Digital File temporarily to a printer, manufacturer, designer, contractor, fulfillment provider, or similar service provider where access is reasonably necessary to complete a permitted project on the customer's behalf.

Such access does not create an independent Commercial License for the service provider.

Digital Artwork Gallery does not impose royalties, production-volume limits, or sales-volume limits on permitted commercial uses unless expressly stated otherwise.

10. NON-EXCLUSIVE NATURE OF DIGITAL ARTWORK

Unless expressly stated otherwise, Digital Artwork is offered non-exclusively.

This means that:

The same Digital Artwork may be purchased or acquired by multiple customers;
Digital Artwork Gallery may continue offering the same Digital Artwork;
Multiple customers may commercially use the same Artwork within the Commercial License;
Multiple customers may modify the Artwork for permitted purposes;
Different businesses may use the same Artwork in overlapping markets; and
Purchasing, Membership-acquiring, or modifying Digital Artwork does not automatically create exclusivity.

A customer or member must not claim exclusive rights that were not expressly granted.

Non-exclusive use does not create a right to resell or redistribute the Digital File.

11. COPYRIGHT OWNERSHIP

The Commercial License grants broad contractual usage rights without representing that the customer or member becomes the exclusive copyright owner of the original Digital Artwork and without transferring ownership of underlying rights held by Digital Artwork Gallery.

Digital Artwork Gallery retains the rights it owns in Artwork provided under the Commercial License.

A Commercial License holder must not represent that they exclusively own the original Digital Artwork unless Digital Artwork Gallery expressly agrees otherwise in writing.

12. TRADEMARK AND EXCLUSIVE REGISTRATION

A Commercial License does not automatically make Digital Artwork appropriate for exclusive:

Trademark registration;
Service-mark registration;
Design-right registration;
Copyright registration; or
Similar exclusive intellectual-property registration.

A Commercial License holder must not seek rights that would improperly interfere with Digital Artwork Gallery or other valid license holders.

Digital Artwork Gallery does not guarantee acceptance of any registration application.

13. INTELLECTUAL PROPERTY IN THE WEBSITE

Except for Artwork rights expressly licensed to customers, the Website and its contents may include intellectual property owned by or licensed to Digital Artwork Gallery or TP E-COMMERCE LLC.

This may include:

Trademarks;
Logos;
Trade names;
Website layouts;
Text;
Graphics;
Product-page design;
Software;
Databases;
Navigation;
Original editorial content; and
Other proprietary materials.

Purchasing Artwork does not transfer ownership of the Digital Artwork Gallery Website, brand, logo, trade name, or unrelated intellectual property.

Artwork usage rights are governed separately by the applicable Commercial License.

14. PROTECTED ACCOUNTS, MEMBERSHIPS, AND DOWNLOAD SYSTEMS

The Commercial License does not authorize customers or members to share or expose Digital Artwork Gallery's protected:

Customer-account credentials;
Membership credentials;
Passwords;
Protected Order pages;
Protected Membership pages;
Private Order history;
Membership account information;
Payment information;
Account sessions;
Security tokens;
Protected download URLs;
Membership discount mechanisms; or
Other customer-specific access mechanisms.

Customers and members must not share Membership access in a manner intended to allow unrelated persons or businesses to use a single Membership as though each independently held Membership rights.

The Digital File may not be shared for another person's independent use except where the Commercial License permits temporary service-provider access.

15. DIGITAL DELIVERY

Digital Artwork Gallery primarily supplies digital products.

Delivery may occur through:

An Order confirmation page;
Order-status page;
Customer account;
Email;
Secure download link;
Digital-delivery application; or
Another electronic method.

Unless expressly stated otherwise, no physical product is shipped.

Digital-delivery terms are described further in the Shipping Policy.

16. FILE SPECIFICATIONS

Artwork product pages may identify technical specifications including:

File type;
Pixel dimensions;
Aspect ratio;
Orientation;
Resolution;
DPI or PPI information; or
Other technical information.

Customers are responsible for evaluating whether advertised specifications are suitable for their intended use.

Digital Artwork Gallery does not guarantee compatibility with every:

Software application;
Printer;
Marketplace;
Production platform;
Print-on-demand service;
AI platform; or
Device.

17. SCREEN AND PRINT VARIATION

Artwork appearance may vary between:

Website previews;
Downloaded files;
Displays;
Browsers;
Devices;
Printers;
Inks;
Papers;
Fabrics;
Canvases;
Materials; and
Lighting environments.

Reasonable variation may result from:

Display calibration;
Brightness;
Color profiles;
Printer profiles;
Compression;
Material properties; and
Production processes.

Such variation does not automatically mean that a Digital File is defective.

18. SERVICE PROVIDERS

Where permitted by the Commercial License, customers may temporarily provide Digital Artwork files to service providers including:

Printers;
Manufacturers;
Designers;
Contractors;
Fulfillment providers; and
Print-on-demand services.

The service provider receives no independent Commercial License and may not retain or exploit the Artwork for unrelated purposes.

Temporary access must be limited to activities reasonably necessary to complete authorized work on behalf of the customer.

19. ACCURACY OF WEBSITE INFORMATION

Digital Artwork Gallery attempts to maintain accurate:

Product descriptions;
Collection information;
Licensing information;
Membership information;
Pricing;
File specifications; and
Policy information.

However, errors or outdated information may occasionally occur.

Digital Artwork Gallery may correct genuine:

Typographical errors;
Technical errors;
Pricing errors;
Availability errors;
Specification errors; or
Policy-linking errors,

subject to existing customer rights and applicable law.

The Commercial License and other governing transaction documents control legal rights where applicable.

20. MARKETPLACE USE

The Commercial License may permit use of validly acquired Digital Artwork on independent commercial platforms where the proposed use itself is permitted by the License.

This may include:

E-commerce platforms;
Print-on-demand platforms;
Social-media platforms;
Advertising platforms;
Manufacturing or fulfillment platforms; and
Other commercial services.

A platform's ability to technically accept or display Artwork does not expand the Commercial License.

In particular, Digital Artwork may not be resold, redistributed, sublicensed, or independently distributed merely because a marketplace technically permits file uploads.

Each third party maintains its own rules.

Digital Artwork Gallery does not guarantee that a particular Artwork or intended use will be accepted by any platform.

A platform's rejection, removal, restriction, account decision, or policy change does not by itself mean that the Digital File is defective or that Digital Artwork Gallery breached the applicable License.

21. THIRD-PARTY SERVICES

Digital Artwork Gallery may rely on independent providers for services including:

Website hosting;
E-commerce infrastructure;
Payment processing;
Subscriptions;
Digital delivery;
Email delivery;
Analytics;
Fraud prevention; and
Other technical services.

Third-party services may be governed by their own terms and policies.

Digital Artwork Gallery does not control every third-party platform and does not guarantee uninterrupted operation of third-party systems.

22. CUSTOMER MODIFICATIONS

The Commercial License permits customers and members to modify Digital Artwork for uses allowed under the License.

Modification may include:

Cropping;
Resizing;
Recoloring;
Compositing;
Adding text;
Combining the Artwork with other elements;
Editing;
Adapting; and
Creating larger original projects.

Modification does not create a right to resell, redistribute, sublicense, or independently distribute the underlying Artwork or a substantially equivalent modified version as a digital asset.

23. AI AND MACHINE-LEARNING USE

Where permitted by the Commercial License, customers and members may use validly acquired Digital Artwork in private creative workflows involving:

AI-assisted editing;
Image-to-image processing;
Reference workflows;
Automated design processes;
Transformative creative workflows; and
Other private commercial creative applications.

Unless expressly authorized in writing, Digital Artwork customers may not:

Distribute the Artwork as training data;
Include the Artwork in downloadable datasets;
Resell or redistribute the Artwork through an AI system;
Make the Artwork available for independent retrieval or reuse by third parties through an AI or machine-learning service;
Sublicense the Artwork through an AI system; or
Use AI processing to circumvent restrictions on digital resale or redistribution.

Third-party systems may impose separate rules.

Digital Artwork Gallery does not guarantee that a particular AI provider will permit every intended use.

24. ARTWORK CREATION METHODS

Digital Artwork Gallery may use combinations of:

Human creative direction;
Digital editing;
Image manipulation;
Compositing;
Computational processes;
Algorithmic tools;
AI-assisted tools; and
Other creative technologies

in developing Artwork.

The extent to which particular elements of a work qualify for copyright or other intellectual-property protection may vary by jurisdiction and by applicable law.

Digital Artwork Gallery grants only rights it actually owns, controls, or is legally entitled to grant.

25. NFTS AND DIGITAL ASSETS

The Commercial License does not permit customers or members to sell, mint, tokenize, distribute, or otherwise offer the original Digital Artwork, or a substantially equivalent version of it, as:

An NFT;
Digital collectible;
Blockchain-linked standalone asset;
Tokenized Artwork; or
Similar standalone digital product.

Use of Digital Artwork inside a broader permitted commercial project does not transfer exclusive ownership rights in the underlying Artwork.

26. NO GUARANTEE OF COMMERCIAL RESULTS

Digital Artwork Gallery does not guarantee that purchasing, Membership-acquiring, modifying, printing, commercially using, or incorporating Artwork into a permitted project will result in:

Sales;
Profit;
Traffic;
Engagement;
Conversions;
Advertising success;
Customer demand;
Licensing revenue;
Marketplace approval;
Business growth; or
Another particular commercial result.

Customers are responsible for evaluating whether Artwork is appropriate for their intended commercial activities.

27. CUSTOMER RESPONSIBILITY

Customers are responsible for evaluating:

Whether an Artwork is suitable for their intended use;
Whether a project requires additional third-party rights;
Applicable marketplace rules;
Local legal requirements;
Trademark implications;
Copyright implications;
Tax obligations;
Manufacturing requirements; and
Other requirements relevant to their own commercial activity.

Nothing on the Website constitutes individualized legal, tax, financial, or investment advice.

28. RETURNS AND REFUNDS

Returns, refunds, replacement files, incorrect delivery, Membership cancellation, payment reversals, chargebacks, and related remedies are governed by the Returns & Refund Policy.

Immediate access to digital products may affect statutory change-of-mind or withdrawal rights where permitted by applicable law and where any required disclosure, consent, or acknowledgment conditions have been satisfied.

Nothing in Digital Artwork Gallery's policies removes mandatory rights that cannot legally be waived.

29. REFUNDS AND COMMERCIAL LICENSE TERMINATION

A valid Commercial License depends on valid acquisition and payment.

Where a Digital Artwork Commercial License terminates following a valid refund, reversal, invalid payment, or material License breach, the purchaser or member may not rely on that terminated License for new:

Commercial use;
Manufacturing;
Physical-product production;
Client work;
Sales relying on the terminated License;
Distribution of Digital Files; or
Other activity requiring the terminated License.

The legal effect of lawful products, projects, or transactions completed while a License was valid is governed by the applicable:

Commercial License;
Terms of Service;
Returns & Refund Policy; and
Applicable law.

Nothing in this section grants resale, redistribution, sublicensing, or file-sharing rights not contained in the Commercial License.

30. LIMITATION OF INFORMATIONAL MATERIAL

Website content, articles, product descriptions, FAQs, examples, marketing materials, and similar information are provided for general informational and commercial purposes.

They should not be interpreted as:

Legal advice;
Tax advice;
Accounting advice;
Financial advice;
Investment advice; or
Professional advice tailored to a particular customer.

Where professional advice is necessary, customers should consult an appropriate qualified professional.

31. WEBSITE AVAILABILITY

Digital Artwork Gallery does not guarantee uninterrupted or error-free access to the Website.

Temporary interruption may result from:

Maintenance;
Security updates;
Infrastructure problems;
Internet outages;
Third-party service failures;
Payment-provider problems;
Cyber incidents;
Software updates; or
Events beyond reasonable control.

Existing valid customer rights remain subject to the governing transaction documents and applicable law.

32. EXTERNAL LINKS

The Website may contain links to third-party websites or services.

A link does not necessarily mean Digital Artwork Gallery:

Controls the third party;
Endorses every third-party statement;
Guarantees the third party's service; or
Accepts responsibility for third-party content.

Third-party service providers may separately process information in connection with:

Digital delivery;

Customers should not send sensitive credentials by ordinary email.

34. COPYRIGHT AND RIGHTS COMPLAINTS

A person who believes Website content infringes rights they own may contact:

35. CUSTOMER-SUPPLIED MATERIAL

Digital Artwork Gallery is not responsible for intellectual-property or other legal issues arising solely from material independently supplied, added, or selected by a customer.

Customers are responsible for ensuring they have sufficient rights to material they independently combine with Artwork.

36. TRADEMARK NOTICE

Names, logos, marks, trade dress, and branding associated with Digital Artwork Gallery or TP E-COMMERCE LLC may be protected by applicable trademark, unfair-competition, or related law.

Purchasing Artwork does not grant a right to represent that a customer is:

Digital Artwork Gallery;
TP E-COMMERCE LLC;
Officially endorsed by Digital Artwork Gallery; or
Formally affiliated with Digital Artwork Gallery

unless expressly authorized.

37. NO IMPLIED ENDORSEMENT

Commercial use of licensed Artwork does not imply endorsement, sponsorship, partnership, certification, or affiliation by Digital Artwork Gallery.

Customers must not falsely imply that Digital Artwork Gallery has approved, sponsored, endorsed, or participated in their independent products, projects, advertisements, or other commercial activities.

38. PRICING INFORMATION

Product and Membership prices are displayed through the Website.

Prices may vary by:

Membership status;
Billing period;
Currency;
Market;
Tax treatment;
Promotion; or
Other disclosed pricing condition.

Gallery Members currently receive:

100% off every digital artwork available at Digital Artwork Gallery.

The final applicable price is displayed through the transaction process before completion, subject to correction of genuine technical or pricing errors as permitted by applicable law.

39. PRODUCT WITHDRAWAL

Digital Artwork Gallery may withdraw products from future availability.

Withdrawal of Digital Artwork from future sale does not ordinarily terminate Commercial Licenses already validly issued.

Digital Artwork Gallery may add, remove, discontinue, or modify future Artwork offerings, subject to existing customer rights and applicable law.

40. POLICY CHANGES

Digital Artwork Gallery may update this Legal Notice to reflect changes in:

Artwork collections;
Memberships;
Licensing;
Website operations;
Delivery systems;
Third-party providers;
Business practices; or
Applicable law.

The version published at the time of a relevant transaction will ordinarily govern that transaction to the extent appropriate.

A later version does not retroactively remove rights already validly granted unless permitted or required by applicable law or expressly agreed.

Copyright ownership.

Returns & Refund Policy

For:

Refunds;
Payment reversals;
Chargebacks;
Digital file problems;
Non-delivery;
Membership refunds; and
License termination following invalidated payments,

the Returns & Refund Policy controls the applicable standard process.

Terms of Service

For general Website, Membership, account, transaction, and contractual matters, the Terms of Service controls.

Mandatory applicable law prevails where legally required.
