6. Full Commercial + Resale License

Eligible Artwork purchases include the rights stated in the applicable Full Commercial + Resale License.

Subject to that License, customers may generally use purchased Artwork for broad personal and commercial purposes.

Permitted uses may include:

  • Personal use;

  • Commercial use;

  • Printing;

  • Physical product sales;

  • Merchandise;

  • Print-on-demand;

  • Digital products;

  • Digital resale;

  • Redistribution;

  • Modification;

  • Derivative works;

  • Client projects;

  • Templates;

  • Collections;

  • Bundles;

  • Downloadable products;

  • Marketplace sales;

  • AI and machine-learning workflows;

  • Dataset use;

  • NFT and blockchain uses; and

  • Other lawful commercial applications.

The applicable Full Commercial + Resale License governs the precise scope of those rights.

7. Digital Resale and Redistribution

Where permitted by the Full Commercial + Resale License, customers may resell and redistribute purchased Artwork.

This may include:

  • Reselling the original Digital File;

  • Offering it as a downloadable product;

  • Selling printable versions;

  • Redistributing the file;

  • Giving copies to others;

  • Including it in a digital bundle;

  • Including it in a collection;

  • Including it in a template;

  • Selling modified versions;

  • Selling derivative versions;

  • Listing it on marketplaces that permit such content; or

  • Supplying it to customers or clients.

Digital Artwork Gallery does not impose:

  • A minimum resale price;

  • Maximum resale price;

  • Royalty percentage;

  • Production-volume limit;

  • Sales-volume limit; or

  • License expiration date

unless expressly stated otherwise in a product-specific written agreement.

8. Non-Exclusive Nature of Artwork

Standard Artwork purchases are non-exclusive.

This means that:

  • The same Artwork may be purchased by multiple customers;

  • Digital Artwork Gallery may continue selling the same Artwork;

  • Multiple customers may commercially use the same Artwork;

  • Multiple customers may resell the same Artwork;

  • Multiple customers may redistribute the same Artwork;

  • Different businesses may use the same Artwork in overlapping markets; and

  • Purchasing or modifying an Artwork does not automatically create exclusivity.

A customer must not claim exclusive rights that were not expressly granted.

9. Copyright Ownership

Purchasing an Artwork does not automatically transfer exclusive copyright ownership of the original Artwork.

To the fullest extent legally applicable, TP E-COMMERCE LLC retains the underlying rights that it lawfully owns or controls.

The Full Commercial + Resale License grants broad contractual usage rights without representing that the customer becomes the exclusive copyright owner of the original Artwork.

Customers may not falsely represent that Digital Artwork Gallery transferred exclusive copyright ownership where no such transfer occurred.

10. Trademark and Exclusive Registration

A commercial or resale License does not automatically make an Artwork appropriate for exclusive trademark registration.

Customers should obtain independent legal advice before attempting to register an Artwork or derivative work as an exclusive:

  • Trademark;

  • Service mark;

  • Logo;

  • Trade dress; or

  • Source identifier.

A customer must not knowingly assert exclusive rights over the original Artwork in a manner that improperly prevents Digital Artwork Gallery or another authorized Licensee from continuing to use it.

Digital Artwork Gallery does not guarantee trademark or copyright registrability.

11. Intellectual Property in the Website

The broad License applying to purchased Artwork does not apply automatically to the entire Digital Artwork Gallery website.

To the fullest extent permitted by law, TP E-COMMERCE LLC and its licensors retain rights they lawfully hold in:

  • The Digital Artwork Gallery name;

  • Logos;

  • Branding;

  • Website text;

  • Product descriptions;

  • Legal policies;

  • Website graphics;

  • Page layouts;

  • Website design;

  • Source code;

  • Databases;

  • Navigation;

  • Checkout systems;

  • Selection and arrangement of content;

  • Internal systems;

  • Internal prompts;

  • Generation workflows;

  • Production methods; and

  • Other proprietary website or business materials.

Public access to the website does not itself grant permission to reproduce, republish, sell, scrape, or commercially exploit those materials.

Purchased Artwork rights are governed separately by the Full Commercial + Resale License.

12. Protected Accounts and Download Systems

Permission to resell or redistribute a purchased Digital File does not authorize a customer to share or expose:

  • Customer-account credentials;

  • Passwords;

  • Protected Order pages;

  • Private Order history;

  • Payment information;

  • Account sessions;

  • Security tokens; or

  • Other customer-specific access mechanisms.

Where resale or redistribution is permitted, customers should transfer the lawfully downloaded Digital File rather than transferring access to a protected customer account or Order session.

13. Accuracy of Website Information

Digital Artwork Gallery makes reasonable efforts to keep:

  • Product descriptions;

  • Prices;

  • File specifications;

  • Policies;

  • License information; and

  • Other website information

accurate and current.

However, the website may occasionally contain:

  • Typographical errors;

  • Technical errors;

  • Pricing errors;

  • Incorrect links;

  • Outdated information;

  • File-specification errors; or

  • Temporary inconsistencies.

Removal does not ordinarily affect valid usage rights previously granted.

  • Enforceable third-party rights; or

  • Another legal obligation.

Any remedy available to an affected customer will depend on the circumstances, applicable law, and the governing purchase documents.

The Full Commercial + Resale License may permit use of purchased Artwork on independent:

  • Digital-asset marketplaces;

  • Print-on-demand platforms;

  • Stock-style marketplaces;

  • NFT marketplaces;

  • AI platforms;

  • Social-media platforms; and

  • Other commercial services.

However, each third party maintains its own rules.

Digital Artwork Gallery does not guarantee that a particular Artwork or intended use will be accepted by any particular platform.

A platform's rejection, removal, restriction, or policy change does not by itself mean that the Digital File is defective or that the License granted by Digital Artwork Gallery was breached.

18. Printing and Physical Production

Digital Artwork Gallery supplies digital Artwork files and does not manufacture physical products unless expressly stated otherwise.

Customers may use independent:

  • Printers;

  • Manufacturers;

  • Print-on-demand providers;

  • Fulfillment companies;

  • Framing providers; or

  • Production contractors

where permitted by the applicable License.

The customer is responsible for evaluating:

  • File requirements;

  • Crop settings;

  • Materials;

  • Printing methods;

  • Color management;

  • Production quality;

  • Fulfillment;

  • Shipping;

  • Platform rules; and

  • Provider terms.

Digital Artwork Gallery is not responsible for physical products independently manufactured by third parties.

19. Color and Display Differences

Artwork appearance may vary between:

  • Computer displays;

  • Smartphones;

  • Tablets;

  • Browsers;

  • Screen settings;

  • Printers;

  • Fabrics;

The Full Commercial + Resale License may permit customers to modify Artwork.

Digital Artwork Gallery is not responsible for issues resulting from customer:

  • Cropping;

  • Resizing;

  • Recoloring;

  • Compression;

  • Conversion;

  • Editing;

  • Added typography;

  • Added logos;

  • Added trademarks;

  • Added images;

  • Combined third-party materials; or

  • Other modifications.

Customers are responsible for ensuring that material they independently add does not unlawfully infringe third-party rights.

21. AI and Machine-Learning Use

Where permitted by the applicable Full Commercial + Resale License, customers may use purchased Artwork in:

  • AI systems;

  • Machine-learning systems;

  • Training;

  • Fine-tuning;

  • Datasets;

  • Validation;

  • Evaluation;

  • Image-to-image processing;

  • Reference workflows;

  • Generative systems; or

  • Other automated creative applications.

Third-party systems may impose separate rules.

Digital Artwork Gallery does not guarantee that a particular AI provider will permit every intended use.

22. NFTs and Digital Assets

Where permitted by the applicable License, customers may use purchased Artwork in:

  • NFTs;

  • Blockchain-linked products;

  • Digital collectibles;

  • Tokenized products; or

  • Similar digital assets.

Such use does not make the customer the exclusive owner of the underlying original Artwork or prevent another Licensee from using the same Artwork.

23. No Professional Advice

Website information is provided for general product, licensing, and commercial-information purposes.

Nothing on Digital Artwork Gallery constitutes individualized:

  • Legal advice;

  • Tax advice;

  • Accounting advice;

  • Investment advice;

  • Copyright-registration advice;

  • Trademark-clearance advice;

25. Rights and Intellectual-Property Complaints
