PURCHASE OPTIONS CANCELLATION POLICY

This Purchase Options Cancellation Policy explains how cancellation works for recurring purchase options, including Gallery Memberships offered by Digital Artwork Gallery.

It also explains how cancellation affects:

  • Future Membership renewals;

  • Current paid Membership Periods;

  • Membership Benefits;

  • Digital Artwork acquired through Membership; and

  • Related licensing and rights.

Nothing in this Policy limits any consumer right or remedy that cannot lawfully be excluded, restricted, or waived.

1. SCOPE OF THIS POLICY

This Policy applies to recurring purchase options offered by Digital Artwork Gallery, including Membership plans under The Gallery.

It governs:

  • Membership cancellation;

  • Cancellation of future renewals;

  • The effect of cancellation on the current paid Membership Period;

  • The effect of cancellation on Membership Benefits;

  • Artwork acquired before cancellation;

  • Renewal charges;

  • Payment reversals; and

  • Related account consequences.

This Policy should be read together with:

  • Terms of Service;

  • Subscription Policy;

  • Returns & Refund Policy;

  • Licensing terms;

  • Commercial License;

  • Privacy Policy;

  • Membership product information; and

  • Applicable checkout terms.

2. GALLERY MEMBERSHIP PLANS

The Gallery may be offered under different recurring billing periods, including:

  • Monthly;

  • Semi-Annual; and

  • Annual Memberships.

The applicable:

  • Membership price;

  • Billing interval;

  • Membership Period;

  • Renewal date;

  • Current Membership Benefits; and

  • Other material purchase terms

are displayed before purchase.

Unless expressly stated otherwise at checkout, Memberships automatically renew at the applicable billing interval until cancelled.

3. CURRENT MEMBERSHIP BENEFITS

While your Gallery Membership is active and validly paid, current Membership Benefits include:

100% off every digital artwork available at Digital Artwork Gallery.

Members may acquire eligible Artwork at no additional Artwork cost while Membership remains active.

Digital Artwork Gallery adds at least 3 new digital artworks every day except Sunday.

The member must still complete the applicable Website acquisition or checkout process for each Artwork.

Membership does not automatically provide or license every Artwork merely because the Membership is active.

Each Artwork must be individually acquired through the available Website process.

4. HOW TO CANCEL YOUR MEMBERSHIP

You may cancel future renewal of your Membership using available:

  • Customer-account tools;

  • Membership-management tools;

  • Subscription-management links; or

  • Another cancellation method made available by Digital Artwork Gallery.

Where appropriate, you may also contact:

info@digitalartworkgallery.com

A cancellation request should include sufficient information for us to reasonably identify the Membership, such as:

  • Your name;

  • Email address used for the Membership;

  • Membership plan; and

  • Other relevant account information.

Do not send:

  • Passwords;

  • Complete payment-card numbers;

  • Card security codes; or

  • Banking login credentials

by ordinary email.

5. EFFECTIVE DATE OF CANCELLATION

Unless otherwise required by applicable law, cancelling a Membership normally:

  • Stops the next scheduled renewal;

  • Does not retroactively cancel the current paid Membership Period;

  • Does not automatically refund the current Membership Period; and

  • Allows Membership Benefits to continue until the end of the already-paid Membership Period.

For example, if an Annual Membership is cancelled during the paid annual period, cancellation normally prevents the next annual renewal while current Membership Benefits continue until the end of the existing paid period.

To avoid the next scheduled renewal charge, cancellation should be completed before the renewal is processed.

6. EFFECT OF CANCELLATION ON MEMBERSHIP BENEFITS

During the remainder of a valid paid Membership Period after cancellation, you may ordinarily continue using Membership Benefits until the applicable period ends.

This may include:

  • 100% off eligible Digital Artwork; and

  • Other Membership Benefits expressly offered during that period.

At the end of the paid Membership Period:

  • The 100% Digital Artwork benefit ends;

  • Future Membership-only pricing ends;

  • Access to future Membership benefits ends; and

  • New Artwork may no longer be acquired using expired Membership Benefits.

A normal cancellation that prevents future renewal does not, by itself, terminate the Commercial License for Digital Artwork validly acquired during a fully paid Membership Period.

7. ARTWORK ACQUIRED BEFORE CANCELLATION OR EXPIRATION

Digital Artwork lawfully acquired while your Membership was active and validly paid ordinarily remains subject to the applicable Commercial License after your Membership ends.

Accordingly, normal Membership cancellation or expiration does not ordinarily require you to stop using Digital Artwork already validly acquired during the paid Membership Period in ways permitted by the Commercial License.

Cancellation or expiration does not create any additional:

  • Resale;

  • Redistribution;

  • Sublicensing;

  • File-sharing; or

  • License-transfer rights.

The Commercial License continues according to its own terms.

However, these rules may not apply where the payment for the applicable Membership Period or Artwork transaction is later:

  • Refunded;

  • Reversed;

  • Charged back;

  • Determined to be unauthorized;

  • Fraudulent; or

  • Otherwise invalidated.

The effect of a refund, reversal, chargeback, unauthorized payment, or similar event is explained in the Returns & Refund Policy, Terms of Service, and Commercial License.

8. CANCELLATION DOES NOT AUTOMATICALLY CREATE A REFUND

Cancelling a Membership does not automatically entitle you to a refund.

Except where applicable law requires otherwise, Membership fees are normally non-refundable once the Membership Period has begun and Membership Benefits have been made available.

This includes where a member:

  • Changes their mind;

  • Cancels shortly after purchase;

  • Cancels shortly after renewal;

  • Does not use the Membership;

  • Downloads no Artwork;

  • Downloads only a small number of Artworks;

  • Does not use the 100% Digital Artwork benefit;

  • Stops using the Website;

  • No longer needs the Membership;

  • Closes a business or project;

  • Fails to cancel before renewal; or

  • Does not achieve expected commercial results.

Mandatory refund or cancellation rights under applicable law remain unaffected.

9. RENEWAL CHARGES

Unless cancelled before renewal, a Membership may automatically renew at the applicable billing interval.

Each successful renewal starts a new paid Membership Period.

The applicable renewal price is determined by the valid Membership terms and pricing applicable to that renewal, subject to applicable law and any required notice.

A renewal charge that has already been processed is not automatically reversed merely because the Membership is cancelled afterward.

Cancellation after renewal normally prevents the following renewal.

10. CANCELLATION BEFORE A SCHEDULED RENEWAL

If cancellation is completed before the next scheduled renewal is processed, Digital Artwork Gallery will ordinarily stop future automatic renewal charges for that Membership.

Processing delays may occur where:

  • A cancellation request is submitted extremely close to the billing time;

  • A third-party subscription system has already initiated processing; or

  • The applicable payment provider has already begun the renewal transaction.

If a charge is processed after a cancellation that should reasonably have prevented renewal, contact Digital Artwork Gallery so that the transaction can be reviewed.

11. PAYMENT REVERSALS AND CHARGEBACKS

A normal Membership cancellation is different from:

  • A refund;

  • Payment reversal;

  • Chargeback;

  • Unauthorized-payment claim; or

  • Payment invalidation.

If a Membership payment is fully:

  • Refunded;

  • Reversed;

  • Charged back;

  • Cancelled as unauthorized; or

  • Otherwise invalidated,

Digital Artwork Gallery may terminate Membership Benefits associated with that Membership Period, subject to applicable law.

Commercial Licenses for Digital Artwork acquired through Membership Benefits during that affected period may also be affected as described in the Returns & Refund Policy and Commercial License.

A normal cancellation that merely stops future Membership renewal does not trigger this rule.

12. REJOINING THE GALLERY

After Membership cancellation or expiration, you may ordinarily purchase a new Gallery Membership if the Membership remains available and your account is eligible.

A new Membership is subject to:

  • The pricing available at the time;

  • Then-current Membership Benefits;

  • Then-current Terms;

  • Applicable billing conditions; and

  • Applicable checkout information.

Previous Membership pricing or terms are not guaranteed for a later Membership purchase.

13. ACCOUNT CLOSURE

Membership cancellation and customer-account closure are separate actions.

Cancelling your Membership does not necessarily delete your customer account.

Closing an account does not automatically:

  • Create a refund;

  • Reverse an Artwork purchase;

  • Revoke a valid Commercial License; or

  • Cancel obligations arising from previous transactions.

Account and privacy matters are governed by the Terms of Service and Privacy Policy.

14. RELATIONSHIP WITH OTHER POLICIES

This Purchase Options Cancellation Policy should be read together with:

  • Terms of Service;

  • Subscription Policy;

  • Returns & Refund Policy;

  • Licensing terms;

  • Commercial License;

  • Shipping Policy;

  • Privacy Policy;

  • Membership product information; and

  • Applicable checkout information.

Commercial License

The Commercial License governs Artwork usage rights, including:

  • Permitted commercial use;

  • Digital resale restrictions;

  • Redistribution restrictions;

  • Sublicensing restrictions;

  • File sharing;

  • License transfer; and

  • Other prohibited uses.

Returns & Refund Policy

For:

  • Membership refunds;

  • Payment reversals;

  • Chargebacks;

  • Unauthorized payments;

  • Refund consequences; and

  • License termination following invalidated payments,

the Returns & Refund Policy controls the applicable standard procedure.

Terms of Service and Subscription Policy

For:

  • Membership billing;

  • Recurring renewal;

  • Membership access;

  • Website use;

  • Account matters; and

  • General contractual matters,

the Terms of Service and Subscription Policy control where applicable.

Mandatory applicable law prevails where legally required.

15. CHANGES TO MEMBERSHIP PLANS

Digital Artwork Gallery may change future:

  • Membership prices;

  • Membership plans;

  • Billing intervals;

  • Membership Benefits;

  • Availability;

  • Subscription technology; or

  • Purchase-option structures,

subject to applicable law, existing contractual commitments, and applicable notice requirements.

Changes do not retroactively reduce Commercial Licenses already validly acquired.

Any applicable notice concerning future renewal changes will be provided where required by law.

16. CHANGES TO THIS POLICY

Digital Artwork Gallery may update this Purchase Options Cancellation Policy to reflect changes in:

  • Membership plans;

  • Cancellation systems;

  • Renewal practices;

  • Pricing;

  • Membership Benefits;

  • Payment providers;

  • Subscription systems;

  • Refund procedures;

  • Business practices; or

  • Applicable law.

The version applicable at the time of the relevant Membership purchase or renewal will ordinarily govern that Membership Period.

A later version may apply where:

  • Required by law;

  • Expressly agreed;

  • Necessary to correct a legal inconsistency; or

  • It grants additional rights without imposing a materially new obligation on an existing member.

17. STATUTORY RIGHTS

Nothing in this Policy removes or restricts any cancellation, cooling-off, renewal, refund, or other consumer right that cannot lawfully be waived.

Depending on your location, mandatory law may provide additional rights concerning:

  • Automatic renewals;

  • Subscription cancellation;

  • Recurring billing;

  • Digital services;

  • Refunds;

  • Disclosure requirements; or

  • Payment disputes.

Where mandatory law conflicts with this Policy, mandatory law controls to the extent of the conflict.

Gallery Members receive 100% off every digital artwork available at Digital Artwork Gallery while Membership is active and validly paid.

Normal Membership cancellation stops future renewal and does not, by itself, terminate previously acquired Commercial Licenses.
