Nothing in this Policy limits any consumer right or remedy that cannot lawfully be excluded, restricted, or waived.
1. THE GALLERY MEMBERSHIPS
Digital Artwork Gallery currently offers recurring Membership plans including:
- The Gallery — Monthly;
- The Gallery — Semi-Annual; and
- The Gallery — Annual.
Each Membership provides the benefits described on the applicable Membership page and during checkout.
While a Membership is active and validly paid, eligible members receive 100% off eligible Digital Artwork included within the Digital Artwork collection.
Digital Artwork Gallery adds at least 3 new Digital Artworks every day except Sunday.
Membership does not automatically deliver every Artwork in the Gallery. Members must acquire eligible Artwork through the available Website, account, checkout, or digital-delivery process while the Membership is active.
2. RECURRING BILLING
Memberships are recurring purchase options.
Unless expressly stated otherwise during checkout, your Membership will automatically renew at the billing interval associated with the plan you select.
Current billing intervals may include:
- Monthly;
- Every six months; or
- Annually.
By purchasing a recurring Membership, you authorize the applicable payment method to be charged at each scheduled renewal until future renewal is cancelled.
Your payment details may be securely stored and processed by our commerce, Membership, and payment-service providers in accordance with their applicable security and privacy practices.
Digital Artwork Gallery does not directly store complete payment-card numbers or card security codes.
3. AUTOMATIC RENEWAL
Unless expressly stated otherwise, Memberships automatically renew until cancelled.
Each successful renewal begins a new paid Membership Period.
The Membership price and billing interval applicable to your purchase are displayed before checkout.
Where required by applicable law, we or our service providers may provide:
- Renewal reminders;
- Recurring-payment notices;
- Price-change notices;
- Cancellation information; or
- Other legally required communications.
A failure to use Membership Benefits does not automatically stop future renewal.
If you do not want your Membership to renew, you must cancel future renewal before the applicable renewal charge is processed.
4. HOW TO CANCEL YOUR MEMBERSHIP
You may cancel future renewal of your Membership at any time through the available Membership-management or customer-account tools.
Where available, your Order confirmation, Membership confirmation, account page, or related email may contain a link allowing you to manage your Membership.
You may also contact:
info@digitalartworkgallery.com
for assistance where appropriate.
Cancellation normally:
- Stops the next scheduled renewal;
- Does not retroactively cancel the current paid Membership Period;
- Does not automatically reverse a renewal charge that has already been processed;
- Does not ordinarily result in a prorated refund for unused Membership time; and
- Allows Membership Benefits to continue until the end of the current validly paid Membership Period.
To avoid the next scheduled renewal charge, cancellation should be completed before that renewal is processed.
5. CANCELLATION AFTER A RENEWAL
If your Membership has already renewed before you cancel it, the cancellation will normally apply to the following renewal.
This means that:
- The current renewed Membership Period remains active;
- Membership Benefits ordinarily continue until the end of that paid period; and
- The Membership will not renew again after that period ends.
Except where applicable law requires otherwise, cancelling shortly after a renewal does not automatically create a right to a full or prorated refund.
Refund eligibility is governed by the Returns & Refund Policy.
6. EFFECT OF CANCELLATION ON MEMBERSHIP BENEFITS
During the remainder of a validly paid Membership Period, you may ordinarily continue using your active Membership Benefits.
When the paid Membership Period ends:
- The 100% member discount ends;
- You may no longer acquire additional Artwork using the expired Membership;
- New Artwork released after expiration is not available under the expired Membership; and
- Other Membership-only benefits end.
A normal cancellation that prevents future renewal does not, by itself, terminate the Full Commercial + Resale License for Artwork validly acquired during a fully paid Membership Period.
7. ARTWORK ACQUIRED BEFORE CANCELLATION OR EXPIRATION
Artwork lawfully acquired while your Membership was active and validly paid ordinarily remains subject to the applicable Full Commercial + Resale License after your Membership ends.
Accordingly, normal Membership cancellation or expiration does not ordinarily require you to stop using Artwork already validly acquired during the paid Membership Period.
However, this rule may not apply where the payment for the applicable Membership Period is later:
- Refunded;
- Reversed;
- Charged back;
- Determined to be unauthorized; or
- Otherwise invalidated.
The effect of a refund, reversal, chargeback, or unauthorized payment on Membership-acquired Artwork is explained in the Returns & Refund Policy and Full Commercial + Resale License.
8. MEMBERSHIP CHANGES
Where supported by our Membership system, you may be able to change your Membership plan.
Available changes may include moving between:
- Monthly;
- Semi-Annual; and
- Annual Memberships.
The timing, billing treatment, effective date, credits, charges, or other consequences of a plan change may depend on:
- The current Membership plan;
- The requested replacement plan;
- The Membership-management platform;
- The payment provider; and
- The terms shown when the change is requested.
Any applicable price or billing information will be displayed before the change is completed where supported by the Membership system.
9. MEMBERSHIP REFUNDS
Except where applicable law requires otherwise, Membership fees are normally non-refundable once the applicable Membership Period has begun and Membership Benefits have been made available.
This includes situations where a member:
- Changes their mind;
- Does not use the Membership;
- Uses the Membership less than expected;
- Downloads no Artwork;
- Downloads fewer Artworks than expected;
- Cancels shortly after purchase;
- Cancels shortly after renewal;
- Fails to cancel before a scheduled renewal; or
- Decides that the Membership is no longer needed.
A refund, credit, extension, or another remedy may nevertheless be available where:
- A duplicate Membership charge occurs;
- A payment is unauthorized;
- Membership access is not supplied because of a problem attributable to Digital Artwork Gallery;
- A material promised Membership Benefit cannot be supplied within a reasonable time; or
- Applicable law requires another remedy.
Full refund and remedy rules are provided in the Returns & Refund Policy.
10. FAILED OR DECLINED PAYMENTS
If a scheduled Membership payment:
- Fails;
- Is declined;
- Is reversed;
- Cannot be authorized; or
- Requires additional verification,
Membership Benefits may be delayed, suspended, or terminated until valid payment is confirmed.
Our payment or Membership provider may attempt to process the payment again where permitted.
We do not guarantee continued Membership Benefits for a Membership Period that has not been validly paid.
11. PAYMENT REVERSALS AND CHARGEBACKS
A genuine unauthorized or incorrectly processed payment may be disputed in accordance with applicable law and payment-provider procedures.
However, a knowingly false, dishonest, or abusive chargeback is prohibited.
Where a Membership payment is fully reversed, refunded, charged back, or otherwise invalidated, Membership Benefits associated with the affected Membership Period may terminate.
Licenses for Artwork acquired through Membership Benefits during that affected period may also be affected as described in the Returns & Refund Policy and Full Commercial + Resale License.
A normal cancellation of future renewal is not the same as a payment reversal.
12. PRE-ORDERS
Digital Artwork Gallery does not currently offer pre-orders as a standard purchase option.
If a pre-order option is introduced in the future, the applicable:
- Payment timing;
- Fulfillment timing;
- Cancellation rights;
- Refund conditions; and
- Other material terms
will be disclosed before purchase.
No product should be treated as a pre-order unless it is expressly identified as such.
13. TRY BEFORE YOU BUY
Digital Artwork Gallery does not currently offer a try-before-you-buy purchase option.
If such an option is introduced in the future, the applicable:
- Authorization amount;
- Trial period;
- Payment timing;
- Decision period;
- Cancellation conditions; and
- Other material terms
will be disclosed before purchase.
No product should be treated as try-before-you-buy unless it is expressly identified as such.
14. STATUTORY CANCELLATION RIGHTS
Depending on your location, mandatory law may provide cancellation, cooling-off, renewal, refund, or recurring-payment rights that apply despite this Policy.
Digital products and digital services may also be subject to special rules where supply or Membership access begins immediately.
Where required by applicable law, you may be asked to expressly request immediate digital supply and acknowledge the effect that immediate supply may have on an otherwise applicable withdrawal or change-of-mind right.
Nothing in this Policy eliminates a right that cannot lawfully be excluded or waived.
